Allergan, the popular maker of Botox, won a court order that blocks Merz Pharma GmbH from selling a rival cosmetic product.
According to the company, the rival product stole its trade secrets.
US District Judge Andrew Guilford issued an injunction against Merz following the trial. Guilford said that his written findings will be released later this week. It will explain the specifics of the injunction, including its length and terms.
One of the company’s concerns is that some of their clients resigned and joined Merz, giving birth to the possibility of misappropriation of Allergan company information.
According to Allergan, Merz recruits from their company brought in confidential materials, including sales statistics and client lists.
“For more than 20 years, we have invested millions of dollars in the research, clinical development and marketing of Botox and we are pleased that our intellectual property has been protected by today’s decision,” said Heather Katt, a spokesperson for Allergan. “We await the exact details of the injunction later this week and have no additional comment at this time.”
